By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

2. Eligibility

To use the Platform, you must be at least 18 years old or of legal age in your jurisdiction to enter into binding contracts. You must not be prohibited from using the Platform under applicable laws, including those governing cryptocurrencies, blockchain technologies, or crowdfunding. You are responsible for complying with all applicable local, national, and international laws, including anti-money laundering (AML) and know-your-customer (KYC) regulations, where required.

3. User Responsibilities

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the security of your account credentials, private keys, and wallet addresses, as the Platform is non-custodial and we do not control your assets. You bear full responsibility for any losses resulting from unauthorized access. You must create and manage crowdfunding campaigns that comply with applicable laws and do not involve fraudulent, misleading, or prohibited activities, such as scams or illegal fundraising. You must refrain from activities that could harm the Platform, including hacking, introducing malware, or attempting to exploit vulnerabilities. You agree to report any security vulnerabilities through our bug bounty program instead of exploiting them. We may suspend or terminate your access to the Platform, or remove your campaigns, if you violate these Terms or engage in activities that compromise the Platform’s integrity or security.

4. Platform Services

The Platform provides decentralized, non-custodial services, each subject to inherent risks.

Crowdfunding Campaigns: You may create and promote meme-based crowdfunding campaigns to raise funds in cryptocurrencies. Campaign success depends on community support, and we do not guarantee funding outcomes.

Donations: You may donate cryptocurrencies to campaigns on the Platform. Donations are processed via smart contracts and are irreversible once confirmed on the blockchain.

Bug Bounty Program: Our bug bounty program rewards users for responsibly disclosing security vulnerabilities in our smart contracts or protocols. Program rules and reward details are available on the Platform.

Third-Party Integrations: The Platform may integrate with third-party wallets, decentralized exchanges (DEXs), or blockchain networks. We are not responsible for the performance, security, or policies of these third-party services.

5. Non-Custodial Nature

The Platform is non-custodial, meaning you retain full control over your cryptocurrencies and private keys. We do not hold, manage, or custody your assets, including funds raised or donated through campaigns. You are solely responsible for securing your wallet and private keys, and we are not liable for any loss of funds due to user error, theft, or compromised keys.

6. Campaign Guidelines

Content Standards: Campaigns must not promote illegal activities, fraud, hate speech, violence, or content that violates applicable laws or our community guidelines, available on the Platform.

Transparency: Campaign creators must provide accurate and truthful information about their fundraising goals, use of funds, and project details.

No Refunds: Donations to campaigns are final and non-refundable, as they are processed on the blockchain. We are not responsible for disputes between campaign creators and donors.

Moderation: We reserve the right to review, suspend, or remove campaigns that violate these Terms or our guidelines, but we are not obligated to monitor all content.

7. Cryptocurrency and Blockchain Risks

Market Volatility: Cryptocurrencies used on the Platform are subject to significant price fluctuations, and we make no representations regarding their value or stability.

Smart Contract Risks: Crowdfunding and donations rely on smart contracts, which may contain vulnerabilities or bugs. You assume all risks associated with smart contract execution.

Irreversible Transactions: Blockchain transactions, including donations, are permanent and cannot be reversed. We are not liable for losses due to incorrect wallet addresses, user errors, or network issues.

Regulatory Risks: Cryptocurrencies and decentralized crowdfunding are subject to evolving regulations, which may impact your ability to use the Platform. You are responsible for ensuring compliance with applicable laws.

8. Security and Audits

Security Audits: We conduct regular audits of our smart contracts and protocols to enhance Platform security. However, audits do not eliminate all risks or vulnerabilities.

Bug Bounty Program: Our bug bounty program incentivizes ethical hackers to report vulnerabilities, contributing to Platform safety. Details are available on the Platform.

No Guarantee of Security: While we implement robust security measures, no decentralized platform is entirely secure. We are not liable for losses resulting from hacks, exploits, or breaches.

9. Intellectual Property

All content on the Platform, including text, graphics, logos, code, and smart contract designs, is owned by or licensed to GoFundMeme.sbs. User-generated content, such as campaign descriptions or images, remains your property, but you grant us a worldwide, non-exclusive, royalty-free license to use, display, and reproduce such content for Platform operations. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent, except as permitted by applicable law.

10. Limitation of Liability

To the fullest extent permitted by law, the Platform is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including loss of funds, data, or profits, or disputes related to crowdfunding campaigns. We do not guarantee the uninterrupted availability, accuracy, or security of the Platform, the success of any campaign, or the actions of campaign creators or donors.

11. Indemnification

You agree to indemnify and hold harmless GoFundMeme.sbs, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights, including disputes related to your crowdfunding campaigns or donations.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Delaware, USA. Any disputes arising from these Terms or your use of the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will take place in Wilmington, Delaware, and you waive any objection to this venue.

13. Modifications to the Terms

We may revise these Terms at any time. Updated Terms will be posted on this page with a revised “Last Revised” date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms. We recommend reviewing this page periodically.

14. Termination

We may suspend or terminate your access to the Platform, or remove your campaigns, at our sole discretion, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately, and provisions of these Terms that by their nature should survive (e.g., limitation of liability, indemnification) will remain in effect.
